The Atlanta Heirs Property Prevention & Resolution Initiative  supports families with either specialized estate planning services or assistance to residents who have inherited property without a clear title.

The newly created Initiative will have two distinct functions:

• Heirs Property Prevention Services: provides estate planning and/or legal services to support the creation of wills, trusts, and other estate planning tools at no cost to the homeowner
• Heirs Property Resolution Services: provide legal services to residents experiencing heirs property challenges and tangled titles at no cost to the homeowner

Invest Atlanta will work directly with vetted homeowners that have applied or received funding from Invest Atlanta’s Heritage Owner Occupied Rehabilitation or Anti-Displacement Tax Relief programs. Invest Atlanta currently has an extensive database of 2,000+ homeowners who meet those criteria, in addition to a robust list of residents that were ineligible for those services due to a lack of clear title or other heirs property challenges.

Eligibility Requirements:

To qualify for the AHPPR Initiative, applicants must meet certain eligibility requirements to ensure the program resources are allocated to families in need. The eligibility requirements will be finalized in coordination with FHLBA and Invest Atlanta’s application partners, but are proposed as follows:

• Ownership Status:

For Heirs Property Prevention Services: Applicants must provide proof of residence and home ownership. Applicants must be a primary homeowner and existing resident of the property for at least five years prior to application. Preference will be given to applicants who have resided in their homes for 15+ years.

For Heirs Property Resolution Services: The property must be classified as heirs property, with the property inherited without a clear or legally recognized title.

• Location: Applicants must reside within the City of Atlanta, with preference given to applicants in the City’s southside and westside neighborhoods.
• Household Income: Annual household income must not exceed 60% of area median income.
• Commitment to Initiative Goals: Participants must demonstrate a willingness to engage in the program’s legal or planning services and provide impact data.
